Court Proceedings
If the tenant does not vacate the property after the eviction notice has expired, the next step is to issue possession proceedings in the County Court.
At this stage, specialist landlord and tenant solicitors will prepare and issue the court claim seeking a possession order against the tenant.
Fixed Fee Court Services

The court will list the matter for a hearing, where legal representation can attend on your behalf and present the case to the judge.
Having the case properly prepared and professionally presented significantly improves the chances of obtaining a possession order and progressing the eviction process without unnecessary delay.

Court Proceedings – Ground 1, Landlord or Family Occupation
£0 (inc VAT)
Ground 1 allows a landlord to recover possession where they, or a close family member, genuinely intend to occupy the property as their home. Our fixed fee for the Stage 2 possession proceedings under Ground 1 (landlord or family occupation) is £XXXX including VAT. This fixed fee “Complete Service” includes the following:
- Preparation and issuing of the possession claim in the County Court
- Preparation of the court documents and witness statement required for an undefended possession claim
- The court issue fee (£404)
- Legal representation at the court hearing*
- Value Added Tax
This service is designed to give landlords certainty over costs when seeking possession where the property is required for occupation by the landlord or a qualifying family member. *This fixed fee applies where the claim proceeds on an undefended basis. If the tenant files a defence or the matter becomes contested, further work and additional costs will be required and will be discussed with you before any such work is undertaken.

Ground 8 is the most commonly used ground where tenants have fallen into significant rent arrears. Our fixed fee for the Stage 2 possession proceedings under Ground 8 (rent arrears) is £XXXX including VAT. As part of this service, we will also include Grounds 10 and 11 where appropriate, at no additional charge, to strengthen the possession claim. This fixed fee “Complete Service” includes the following:
